Welcome to the Vibrant Living Lab Club, known as “The Service,” which is owned and operated by Vibrant Living Labs, referred to as “The Company.”

Vibrant Living Labs retains the right to modify the Terms of Use, and the most up-to-date version can be found in the SMS Terms and Conditions.

By signing up for the Vibrant Living Lab Club SMS service on our website, you are acknowledging your agreement to join the Vibrant Living Lab Club Service, abide by these Terms of Use, and receive messages on your mobile phone. Upon subscribing to the Vibrant Living Lab Club service, you will receive recurring messages.

Fees:

Participation in the Vibrant Living Lab Club Service does not incur any charges from Vibrant Living Labs. However, standard message and data rates may apply as imposed by your wireless carrier. For information on text messaging fees, please consult your wireless carrier. Vibrant Living Labs cannot be held responsible for any fees levied by your wireless carrier for using The Vibrant Living Lab Club service.

Privacy:

At Vibrant Living Labs, we highly value and safeguard your privacy. We do not share any collected information. To review our Privacy Policy, please refer to the appropriate section.

Limitations on Use:

To register for and utilize the Vibrant Living Lab Club service, you must be at least 17 years old. If you are under 17 years old, please seek parental consent before signing up for the Vibrant Living Lab Club service.

Supported Carriers:

Mobile carriers are not liable for delayed or undelivered messages. Participating carriers include T-Mobile®, Verizon Wireless, AT&T, Sprint, Boost, U.S. Cellular®, MetroPCS, Virgin Mobile, and Cricket.

Support Issues, Canceling or Unsubscribing:

You have the option to opt out of the Vibrant Living Lab Club service at any time by sending a text message with the keywords STOP, QUIT, END, CANCEL, UNSUBSCRIBE, or STOP ALL to {Insert Program Code}. Message and data rates may apply. Alternatively, you can email [email protected] using your mobile phone number as the subject line. For assistance or other support matters, you can also send an email to [email protected] or text HELP to {Insert Program Code} from your mobile phone, or call the toll-free number 844-586-5223. Message frequency is based on account activity.

Ownership; Trademarks; Modifications to Offers:

By agreeing to these terms, you acknowledge that Vibrant Living Labs or its partners hold all legal rights, titles, and interests in the Vibrant Living Lab Club services and any offers provided through the Vibrant Living Lab Club services, including any associated intellectual property rights. You agree not to modify any offers made through the Vibrant Living Lab Club service, and not to remove, obscure, or alter any proprietary rights notices (including copyright or trademark notices) affixed to the Vibrant Living Lab Club services or offers. Unless expressly authorized by a partner, you agree not to use any Trademarks (service marks, trade names, or logos) of any entity in a way that may cause confusion regarding ownership or be detrimental to the goodwill associated with such Trademarks.

Termination:

Vibrant Living Labs reserves the right, at its sole discretion, to terminate your subscription at any time without notice or future obligation.

Disclaimer of Warranties:

Vibrant Living Labs provides no warranties, express or implied, regarding the Vibrant Living Lab Club service. The service is provided “as is” and “as available,” and Vibrant Living Labs DISCLAIMS ALL WARRANTIES OF ANY KIND, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Factors beyond the control of Vibrant Living Labs, such as the speed of mobile carrier networks and the internet, may impact the service’s performance. Vibrant Living Labs is not responsible for any acts beyond its control.

Limitation of Liability:

Under no circumstances will Vibrant Living Labs, its officers, directors, employees, or agents be liable to you for any damages arising from your use of the Vibrant Living Lab Club service. This includes, but is not limited to, direct, indirect, incidental, consequential, exemplary, or special damages, even if advised of the possibility of such damages. If any disclaimer or limitation on damages or liability set forth herein is prohibited by applicable law in a particular circumstance, Vibrant Living Labs will be entitled to the maximum disclaimers and/or limitations on damages and liability available under such applicable law. Notwithstanding the foregoing, in no event will Vibrant Living Labs be liable for any damages or liability arising under these terms of use or your use of the Vibrant Living Lab Club service that exceeds US $500.

Indemnity:

You agree to indemnify and hold harmless each party associated with Vibrant Living Labs from any claim, demand, damages, costs, or expenses, including reasonable attorneys’ fees and costs, arising from your breach of this agreement or the referenced documents, or your violation of any law or the rights of another party.

Governing Law; Venue:

This agreement, including its validity, construction, and performance, will be governed by the laws of the state of Colorado, without regard to its choice of law provisions. You agree to accept the exclusive personal jurisdiction of the state and federal courts of Colorado and waive any objections to the venue of such courts.
